However, this seemingly simple and innocuous practice is actually very harmful: while the data is inaccurate, it also heats up rumors, allowing inferior content to overwhelm high-quality content, which has a profound impact on the entire Internet industry. For ordinary users who make money by hosting accounts, it is not the legendary loss of money. Not only is personal information leaked, but it may also become an accomplice in black industrial chains such as fraud, pornography, gambling and drugs.
This is not an alarmist. Recently, a hanging-up brushing case pronounced by the Intermediate People’s Court of Shenzhen, Guangdong Province, uncovered the tip of the iceberg of hanging-up brushing: Shenzhen Microspace Information Technology Co., Ltd. (hereinafter referred to as Microspace Company) and Zhao used Baoxin hanging-up platform to manipulate the rented WeChat account, and at the same time used Baoxin ticketing platform to brush the number of likes, votes, comments and concerns, and obtained huge economic benefits from it.
The court held that the two defendants used technical means to implement the brushing behavior, which hindered and destroyed the normal operation of WeChat software products and services legally provided by the plaintiff Tencent. At the same time, the two defendants helped other operators to make false propaganda or introduce misunderstood commercial propaganda, which violated the provisions of Articles 8 and 12 of the Anti-Unfair Competition Law. It was an unfair competition behavior and compensated Tencent for economic losses of 23,745,080 yuan.

In the long run, it will inevitably lead to the reduction of trust in platform information by most users, which will have a de facto derogatory effect on the reputation of the platform, damage the overall reputation of the platform, and reduce the trust of other users of the platform in platform data, thus damaging the legitimate rights and interests of the plaintiffs.
At the same time, the two defendants used technical means to implement the brushing behavior, which undermined the normal operation of WeChat software products and services legally provided by the two plaintiffs. The brushing behavior of the two defendants also caused the relevant market operators, social organizations and the majority of WeChat users to be unable to collect and analyze the above-mentioned clean and real data, thus disrupting the market competition order and damaging the legitimate rights and interests of the majority of WeChat users and the public.

Zhou Dandan, a partner of Beijing Yuntian Law Firm, believes that in the hanging-up brushing case pronounced by Shenzhen Intermediate People’s Court, the court fully applied the "proof obstruction rule", and under the circumstances that the defendant did not submit the evidence without justifiable reasons and made false statements, the adverse evidence was presumed, and punitive damages were applied to severely punish the false brushing behavior.
In Zhou Dandan’s view, in the era of Internet platform economy, court decisions have a very positive effect on severely cracking down on the industry chaos of data fraud. Only when all participants in the platform jointly safeguard the authenticity and credibility of platform data can we build a fair and orderly competitive environment conducive to increasing the overall welfare of society.
In addition to judicial regulation, from the perspective of government supervision, in recent years, the regulatory authorities have paid more and more attention to the industrial chain of brushing black and gray, and imposed heavy punches on brushing behavior.
On December 20, 2019, the National Network Information Office issued the "Regulations on Ecological Governance of Network Information Content", which clearly mentioned that network information content service users, network information content producers and network information content service platforms should not implement traffic fraud, traffic hijacking, false registration of accounts, illegal trading of accounts, manipulation of user accounts, etc. by manual means or technical means, thus undermining the ecological order of the network.
Deng Xin said that at present, there are still many other online brushing platforms in the market that are still in operation. It is urgent for the judicial department and the regulatory department to unify their understanding, clarify problems and strictly enforce the law, and fundamentally eradicate the foundation of this illegal industry.
