The Ministry of Industry and Information Technology issued the Interim Measures for the Gradient Cultivation and Management of High-quality SMEs.

  In order to further strengthen the gradient cultivation of high-quality SMEs and promote the high-quality development of SMEs, the Ministry of Industry and Information Technology recently issued the Interim Measures for the Administration of Gradient Cultivation of High-quality SMEs. The text of the "Measures" consists of five chapters. The first chapter is general, which puts forward the basis, concept and definition, working principles, division of responsibilities and working objectives. The second chapter is evaluation and identification, which clarifies the principles, standards and related work requirements of evaluation and identification. The third chapter is dynamic management, which puts forward management principles and requirements for updating enterprise information, as well as management requirements such as validity period, violation of laws and regulations and acceptance of reports. The fourth chapter puts forward the principles, contents and methods of gradient cultivation. The fifth chapter, supplementary provisions, defines the implementation date, etc. The "Measures" clarify the evaluation or identification criteria for innovative small and medium-sized enterprises, specialized and innovative small and medium-sized enterprises, and specialized and innovative "little giant" enterprises, and publish them in the form of annexes. These Measures shall be implemented as of August 1, 2022.

  Interim Measures for the Gradient Cultivation and Management of High-quality Small and Medium-sized Enterprises

  Chapter I/General Provisions

  Article 1 In order to enhance the innovation ability and professional level of small and medium-sized enterprises, promote their high-quality development, and help realize the upgrading of industrial base and the modernization of industrial chain, these Measures are formulated in accordance with the Outline of the 14th Five-Year Plan for National Economic and Social Development in People’s Republic of China (PRC) and the Long-term Objectives for 2035, the 14th Five-Year Plan for Promoting the Development of Small and Medium-sized Enterprises, and Several Opinions on Improving the System for Supporting the Development of Small and Medium-sized Enterprises.

  Article 2 High-quality small and medium-sized enterprises refer to small and medium-sized enterprises with strong innovation ability in products, technology, management and mode, focusing on market segmentation and good growth. They are composed of innovative small and medium-sized enterprises, specialized and innovative small and medium-sized enterprises and specialized and innovative "little giant" enterprises. Innovative small and medium-sized enterprises have high professional level, strong innovation ability and development potential, and are the basic strength of high-quality small and medium-sized enterprises; Specialized and innovative small and medium-sized enterprises are the backbone of high-quality small and medium-sized enterprises, realizing professional, refined and characteristic development, with strong innovation ability and good quality and efficiency; Specialized and innovative "Little Giant" enterprises are located in the core areas of industrial foundation and key links of industrial chain, with outstanding innovation ability, mastering core technologies, high market share and good quality and efficiency, and are the core strength of high-quality small and medium-sized enterprises.

  Article 3 The participating high-quality small and medium-sized enterprises should be registered in industrial and commercial registration, People’s Republic of China (PRC), have independent legal personality, and conform to the Standard Provisions on the Classification of Small and Medium-sized Enterprises. The enterprises are not listed in the list of abnormal operations or the list of subjects with serious dishonesty, and the products (services) provided are not prohibited, restricted or eliminated by the state. At the same time, there have been no major accidents such as network security and data security, quality and environmental pollution, and tax evasion and other illegal acts in the past three years.

  Article 4 The gradient cultivation of high-quality small and medium-sized enterprises shall adhere to the complete, accurate and comprehensive implementation of the new development concept, the specialization and new development direction, the combination of effective market and promising government, the hierarchical guidance, dynamic management and accurate service.

  Article 5 The Ministry of Industry and Information Technology is responsible for the macro guidance, overall coordination, supervision and inspection of the gradient cultivation of high-quality small and medium-sized enterprises, promoting the introduction of relevant supporting policies, releasing relevant evaluation and accreditation standards, and being responsible for the accreditation of "little giant" enterprises that specialize in novelty. Departments in charge of small and medium-sized enterprises in all provinces, autonomous regions, municipalities directly under the Central Government, cities specifically designated in the state plan, and Xinjiang Production and Construction Corps (hereinafter referred to as provincial departments in charge of small and medium-sized enterprises) shall formulate detailed rules according to these Measures and report them to the Ministry of Industry and Information Technology for the record, and be responsible for the gradient cultivation of high-quality small and medium-sized enterprises in the region according to the detailed rules, and for the identification of specialized and innovative small and medium-sized enterprises and the evaluation of innovative small and medium-sized enterprises. Other institutions shall not carry out evaluation, identification, licensing and other activities related to innovative small and medium-sized enterprises, specialized and innovative small and medium-sized enterprises and specialized and innovative "little giant" enterprises.

  Article 6 The competent departments of small and medium-sized enterprises at all levels should strengthen the dynamic management of high-quality small and medium-sized enterprises, and establish and improve the dynamic management mechanism of "what goes in and what goes out". During the "Fourteenth Five-Year Plan" period, efforts will be made to promote the cultivation of 1 million innovative small and medium-sized enterprises, 100,000 specialized and innovative small and medium-sized enterprises and 10,000 specialized and innovative "little giant" enterprises throughout the country.

  Article 7 The Ministry of Industry and Information Technology shall build a gradient cultivation platform for high-quality small and medium-sized enterprises (https://zjtx.miit.gov.cn/, hereinafter referred to as the cultivation platform) and build a database for high-quality small and medium-sized enterprises. The competent departments of small and medium-sized enterprises at all levels should strengthen service docking and monitoring analysis, carry out regular and irregular tracking on the operation, development trend, opinions and demands of enterprises, as well as supporting policies and cultivation effects, and formulate policies and carry out accurate services in a targeted manner; Further implement the "streamline administration, delegate power, strengthen regulation and improve services" requirements, promote the sharing of enterprise-related data, and reduce the burden of enterprise data reporting.

  Chapter II/Evaluation and Identification

  Article 8 The evaluation and identification of high-quality small and medium-sized enterprises shall adhere to the principles of policy guidance, voluntary enterprise, fostering and promoting, openness and transparency, and be carried out in a coordinated and orderly manner according to the mode of "who recommends, who checks, who audits and who manages".

  Article 9 The Ministry of Industry and Information Technology issues and timely updates the evaluation criteria for innovative small and medium-sized enterprises (Annex 1), the identification criteria for specialized and innovative small and medium-sized enterprises (Annex 2) and the identification criteria for specialized and innovative "little giant" enterprises (Annex 3). The "characteristic index" in the identification standard of specialized and innovative small and medium-sized enterprises shall be set and published by the provincial department in charge of small and medium-sized enterprises in combination with the local industrial situation and the actual development of small and medium-sized enterprises.

  Article 10 In the evaluation of innovative small and medium-sized enterprises, enterprises voluntarily log on to the cultivation platform to participate in the self-evaluation according to the principle of territoriality, and the competent department of small and medium-sized enterprises at the provincial level shall organize the review, spot check and publicity of the self-evaluation information and relevant supporting materials of enterprises according to the evaluation criteria. If there is no objection to the publicity, it will be announced as an innovative small and medium-sized enterprise by the provincial competent department of small and medium-sized enterprises.

  Article 11 For the accreditation of specialized and innovative small and medium-sized enterprises, innovative small and medium-sized enterprises shall apply voluntarily according to the principle of territoriality, and the competent department of small and medium-sized enterprises at the provincial level shall, according to the accreditation standards, organize the review, spot check and publicity of enterprise application materials and relevant supporting materials. If there is no objection to the publicity, it shall be recognized as a specialized and innovative small and medium-sized enterprise by the provincial competent department of small and medium-sized enterprises.

  Article 12 "Little Giant" enterprises with specialization and novelty shall apply voluntarily according to the principle of territoriality, and the competent department of small and medium-sized enterprises at the provincial level shall conduct preliminary examination and spot check on the enterprise application materials and relevant supporting materials according to the accreditation standards, and recommend them to the Ministry of Industry and Information Technology if they pass the preliminary examination. The Ministry of Industry and Information Technology organizes the review, spot check and publicity of the recommended enterprises. If there is no objection to the publicity, it will be recognized as a "little giant" enterprise specializing in novelty by the Ministry of Industry and Information Technology.

  In principle, in the second quarter of each year, the organization will carry out the identification of specialized and innovative "little giant" enterprises, and the provincial competent department of small and medium-sized enterprises should make overall plans for the evaluation of innovative small and medium-sized enterprises, the identification of specialized and innovative small and medium-sized enterprises and the recommendation of specialized and innovative "little giant" enterprises according to the work requirements.

  Chapter III/Dynamic Management

  Thirteenth announced innovative small and medium-sized enterprises are valid for three years. After each expiration, the enterprises will re-log in to the cultivation platform for self-evaluation, and the validity period will be extended for three years after being approved by the provincial competent department of small and medium-sized enterprises (including spot checks). The validity period of the identified specialized and innovative small and medium-sized enterprises and specialized and innovative "little giant" enterprises is three years. After each expiration, the identified department will organize a review (including spot checks), and the validity period will be extended for three years if the review is passed.

  Fourteenth innovative small and medium-sized enterprises, specialized and innovative small and medium-sized enterprises and specialized and innovative "little giant" enterprises within the validity period should update their enterprise information through the cultivation platform before April 30 each year. If the enterprise information is not updated in time, the qualification for review will be cancelled.

  Article 15 During the validity period, innovative small and medium-sized enterprises, specialized and innovative small and medium-sized enterprises and specialized and innovative "little giant" enterprises, such as renaming, merger, reorganization, inter-provincial migration, establishment of overseas branches and other major changes related to the evaluation and identification conditions, should log on to the cultivation platform within 3 months after the changes, and fill in the report form of major changes. Innovative small and medium-sized enterprises and specialized new small and medium-sized enterprises that no longer meet the evaluation or identification standards shall be cancelled by the provincial department in charge of small and medium-sized enterprises after verification; Specialized and innovative "little giant" enterprises that no longer meet the accreditation standards shall be reported to the Ministry of Industry and Information Technology after verification by the competent department of small and medium-sized enterprises at the provincial level, and shall be cancelled by the Ministry of Industry and Information Technology. For those who fail to report major changes within 3 months, the qualification for review shall be cancelled, or the announcement or confirmation shall be cancelled directly.

  Article 16 Within the validity period, innovative small and medium-sized enterprises, specialized and innovative small and medium-sized enterprises and specialized and innovative "little giant" enterprises will directly cancel the announcement or identification if they have major accidents such as safety (including network safety and data safety), quality and environmental pollution, or serious violations of laws and regulations such as dishonesty and tax evasion, or if they are found to have fraudulent data, and they shall not declare again for at least three years.

  Article 17 Any organization or individual may report to the competent department of the corresponding small and medium-sized enterprises with real names for the problems existing in the authenticity and accuracy of the information related to innovative small and medium-sized enterprises, specialized and innovative small and medium-sized enterprises and specialized and innovative "little giant" enterprises, and provide supporting materials and contact information. For the content of the accepted report, the corresponding competent department of small and medium-sized enterprises should promptly verify with the reported enterprise. If the reported enterprise fails to reply as required or confirms that the enterprise has fraudulent behavior after verification, it will require the enterprise to make rectification according to the seriousness of the case, or directly cancel the announcement or identification.

  Chapter IV/Cultivation and Support

  Article 18 The competent department of small and medium-sized enterprises should establish a gradient cultivation system for high-quality small and medium-sized enterprises according to the characteristics and needs of different types of small and medium-sized enterprises in different stages of development in the region, formulate special support policies for hierarchical classification, increase service, safeguard the legitimate rights and interests of enterprises, continuously optimize the development environment of small and medium-sized enterprises, and stimulate the emergence of a large number of specialized and special new enterprises.

  Nineteenth departments in charge of small and medium-sized enterprises should play the role of coordinating mechanism to promote the development of small and medium-sized enterprises, strengthen departmental coordination and linkage, and form a joint effort. Coordinate the use of fiscal, taxation, finance, technology, industry, talents, land use, energy use and other policy tools to continuously support the development of high-quality small and medium-sized enterprises and improve the accuracy and effectiveness of policies.

  Article 20 The competent department of small and medium-sized enterprises should focus on building a service system that promotes government public services, market-oriented services and public welfare services in coordination, and pool service resources and innovate service methods to provide full-cycle, all-round and multi-level services for small and medium-sized enterprises by building platforms such as docking innovation achievements, integrating innovation among large and medium-sized enterprises, and docking supply and demand. Through the combination of inclusive service and precise service, we will strive to improve the breadth, depth, accuracy and response speed of services and enhance the sense of enterprise acquisition.

  Article 21 The competent department of small and medium-sized enterprises and all kinds of small and medium-sized enterprise service agencies should strengthen guidance and services, promote small and medium-sized enterprises to improve their corporate governance, fine management and compliance management, guard against all kinds of risks, promote sustained and healthy development, and give full play to the exemplary role of high-quality small and medium-sized enterprises. In the process of evaluation, identification and service, we should pay attention to the protection of business secrets of enterprises, and obtain the consent of enterprises before publicity, reporting, investigation and exchange.

  Chapter V/Supplementary Provisions

  Article 22 The Ministry of Industry and Information Technology shall be responsible for the interpretation of these Measures.

  Article 23 These Measures shall be implemented as of August 1, 2022. The specialized and innovative small and medium-sized enterprises that have been recognized by the provincial competent department of small and medium-sized enterprises before August 1 and the specialized and innovative "little giant" enterprises that have been recognized by the Ministry of Industry and Information Technology will continue to be effective. The validity period (no more than 3 years at the longest) will automatically become invalid after expiration, and the review shall be carried out in accordance with these measures.

  Evaluation criteria of innovative small and medium-sized enterprises

  Announcement conditions

  The evaluation score is above 60 (including the score of innovation ability index is not less than 20, and the scores of growth index and specialization index are not less than 15), or one of the following conditions is met:

  (a) won the national and provincial science and technology awards in the past three years.

  (two) to obtain the honor of high-tech enterprises, national technological innovation demonstration enterprises, intellectual property advantage enterprises and intellectual property demonstration enterprises (all within the validity period).

  (3) Having a recognized R&D institution at or above the provincial or ministerial level.

  (4) The total amount of newly-increased equity financing in recent three years (paid-in amount of qualified institutional investors) is more than 5 million yuan.

  (2) The total R&D expenditure in the previous year was not less than 1 million yuan, and the proportion of R&D expenditure in the total operating income was not less than 3%.

  (3) The total operating income in the previous year was more than 10 million yuan, or the total operating income in the previous year was less than 10 million yuan, but the total amount of newly-increased equity financing (paid-in by qualified institutional investors) in the last two years reached more than 20 million yuan.

  (four) the evaluation score reached 60 points or above or meet one of the following conditions:

By the end of last year, the enterprise had been engaged in specific market segments for more than 3 years, and the total income from main business accounted for no less than 70% of the total operating income, and the average growth rate of main business income in recent 2 years was no less than 5%.

  Refined index

  Pay attention to and implement the long-term development strategy, with standardized corporate governance, good reputation, strong sense of social responsibility, leading domestic production technology, process and product quality and performance, and paying attention to digital and green development. At least one core business is supported by information system in R&D design, manufacturing and supply chain management. Obtain the relevant management system certification, or the product has passed the product certification of developed countries and regions (industry certification of International Standards Association). By the end of last year, the asset-liability ratio of enterprises was not higher than 70%.

  three

  Characteristic index

  Technology and products have their own unique advantages, leading products in the national market share of more than 10%, and enjoy high visibility and influence. Have an independent brand that is directly oriented to the market and has a competitive advantage.

  four

  Innovation ability index

  Meet the general conditions or innovative through conditions.

  (1) General conditions. The following three items must be met at the same time:

  1. For enterprises with a total operating income of more than 100 million yuan in the previous year, the total R&D expenses accounted for no less than 3% of the total operating income in the past two years; Last year’s total operating income was 50 million yuan — For enterprises with 100 million yuan, the total R&D expenses accounted for no less than 6% of the total operating income in the past two years; For enterprises with a total operating income of less than 50 million yuan in the previous year, the total amount of newly-increased equity financing (paid-in by qualified institutional investors) in the past two years is more than 80 million yuan, and the total R&D expenses are more than 30 million yuan, and R&D personnel account for more than 50% of the total employees of the enterprise.

  2. Self-built or jointly established R&D institutions with institutions of higher learning and scientific research institutions, and set up technical research institutes, enterprise technology centers, enterprise engineering centers, academician expert workstations, postdoctoral workstations, etc.

  3. Have two or more Class I intellectual property rights related to leading products, which have been applied in practice and have produced economic benefits.

  (2) Innovative direct access conditions. Just meet one of the following requirements:

  1 in the past three years won the national science and technology award, and ranked in the top three in the award-winning units.

  2. In the past three years, it has entered the list of the top 50 enterprises in the "Maker China" SME Innovation and Entrepreneurship Competition.

  five

  Supporting indicators of industrial chain

  Located in the key link of the industrial chain, it realizes the industrial application of key basic technologies and products around key industrial chains, and plays an important role in "filling short board", "forging long board" and "filling blank".

  six

  Indicators of leading products’ fields.

  In principle, leading products belong to the following key areas: engaging in market segmentation belongs to the core basic parts, components, key software, advanced basic technology, key basic materials and industrial technology foundation of manufacturing industry; Or in line with the top ten key industrial fields of the strategy of manufacturing a strong country; Or belong to the information infrastructure, key core technologies, network security, data security and other products built by network powers.

  (1) Unless otherwise specified, the indicators generally use the annual data of the enterprise in the last year, which is specifically defined as: the last complete accounting year of the enterprise, subject to the number of audit reports at the end of the previous year. For enterprises with subsidiaries or parent companies, the relevant provisions of the Accounting Standards for Business Enterprises issued by the Ministry of Finance shall apply.

  (2) The term "owning an independent brand" means that the products or services of the main business have independent intellectual property rights and meet one of the following conditions:

  1. The product or service brand has been officially registered by China National Intellectual Property Administration Trademark Office.

  2. The product or service has realized income.

  (3) The term "Class I intellectual property rights" includes invention patents (including national defense patents), new plant varieties, national crop varieties, national new drugs, national first-class protected varieties of traditional Chinese medicine, and exclusive rights in layout-design of integrated circuits (all of which do not include intellectual property rights that have been transferred for less than one year).

  (4) The term "Class I high-value intellectual property rights" shall meet one of the following conditions:

  1. Invention patents with the same family patent right overseas or other Class I intellectual property rights with overseas income, among which patents are limited to invention patents authorized by G20 members, Singapore and the European Patent Office after substantive examination.

  2. Class I intellectual property rights that have been maintained for more than 10 years.

  3. Class I intellectual property rights with higher pledged financing amount.

  4. Class I intellectual property rights won the National Science and Technology Award or the China Patent Award.

  (5) The term "Class II intellectual property rights" includes software copyrights (excluding trademarks) related to leading products, utility model patents or design patents that have been maintained for more than two years after authorization (excluding intellectual property rights that have been transferred for less than one year).

  (6) The term "digital transformation level of enterprises" refers to the completion of free self-test of digital level on the gradient cultivation platform of high-quality small and medium-sized enterprises, and the specific self-test website and related standards shall be specified separately.

  (7) The "major safety (including network safety and data safety), quality, environmental pollution and other accidents" refers to the supervision departments at all levels, such as product safety, production safety, engineering quality safety, environmental protection and network safety, in accordance with People’s Republic of China (PRC) Law on Work Safety, People’s Republic of China (PRC) Law on Environmental Protection, Regulations on Reporting, Investigation and Handling of Work Safety Accidents, Network Security Law of the People’s Republic of China, People’s Republic of China (PRC) Data Security Law and other laws and regulations.

  (8) The term "equity financing" refers to the way that shareholders of a company dilute part of the company’s equity to investors, and introduce new shareholders by way of increasing capital and shares (transferring equity does not exceed 30%), so as to obtain corporate financing.

  (9) The term "qualified institutional investors" refers to venture capital funds and private equity investment funds that meet the relevant provisions of the Interim Measures for the Administration of Venture Capital Enterprises (Order No.39 of the Development and Reform Commission and other 10 departments) or the Interim Measures for the Supervision and Administration of Private Equity Funds (Order No.105 of the CSRC), which have been filed and standardized in accordance with the above provisions.

  (10) The term "leading product" means that the core technology of the enterprise plays an important role in the product, and the sum of product income accounts for more than 50% of the operating income of the enterprise in the same period.

  (eleven) the so-called "leading products in the national market share of more than 10%, and enjoy a high visibility and influence" can be proved by self-certification or other means.

  (twelve) the term "provincial science and technology awards" includes the first, second and third prizes of science and technology awards of all provinces, autonomous regions and municipalities directly under the central government; "National Science and Technology Awards" include the National Science and Technology Progress Award, the National Natural Science Award, the National Technology Invention Award, and the National Defense Science and Technology Award.

When calculating the evaluation index score, if the index value is located at the boundary of two scoring intervals, the score will be calculated according to the high score.

The calculation method of income growth rate of main business in other years is similar.

  (fifteen) the so-called "being included in the business exception list" shall be subject to the query results of the national enterprise credit information publicity system (http://www.gsxt.gov.cn); The so-called "list of serious untrustworthy subjects" is subject to the query results of Credit China (http://www.creditchina.gov.cn).

  (16) The list of the top 500 and top 50 enterprises in the "Chuangke China" SME Innovation and Entrepreneurship Competition refers to the list officially released since 2021.
